YD Group protects all processed personal data as strictly confidential and handles it in accordance with applicable legal regulations on personal data protection.

2. SCOPE OF PERSONAL DATA PROCESSING

In the course of using our suppliers' services and in our interactions with the public, we process various types of personal data, including:

First and last name

Business name

Personal identification number and date of birth

Identification number or tax identification number of a legal entity

Contact address, permanent residence address, registered office address

Type of personal identification document and its number, signature

Phone number

Email address

Bank account number or other transaction data, as well as any other personal information provided to us by data subjects in the course of service provision or communication

Data on the movement of the data subject, particularly entry and exit records from our premises

Our website does not use cookies.

The personal data we process is obtained directly from the data subjects.

We store personal data exclusively on company servers or with our trusted partners.

3. PURPOSE AND LEGAL BASIS FOR PROCESSING YOUR DATA

The YD Group processes your personal data primarily for the following purposes:

• Contract Performance: (Fulfilling contracts with data subjects, particularly in meeting our payment obligations and communicating with data subjects. Providing data is a contractual requirement, without which we cannot properly fulfill the signed contract.)
• Compliance with Legal Obligations: (Requirements related to accounting and tax legislation, such as transferring personal data to public authorities in accordance with relevant laws. Providing data is a legal requirement, and without it, we cannot properly fulfill our legal obligations.)
• Archiving and Communication Assurance: (We retain documents related to contractual cooperation and communications with data subjects, including communications data, for the duration of contractual cooperation and up to 3 years after its termination to protect our legitimate interests and demonstrate our claims, especially by documenting past communication, contractual commitments, and guarantees. This is neither a contractual nor legal requirement. Additionally, under VAT law, we must retain tax documents from data subjects for 10 years from the end of the tax period in which the performance occurred. After this period, we may process personal data only for compatible or special purposes such as archiving or statistics.)
• Protection of YD Group’s Legitimate Interests: (In exceptional cases, particularly for the purpose of enforcing YD Group's legal claims, based on its legitimate interest in maintaining its continued operation.)
• Protection of Access to YD Group Premises: (For secure and orderly movement, we may process identification data and movement data of our visitors. These data are processed for a maximum of 2 months from the last visit, based on our legitimate interest in protecting YD Group property. You are not required to provide these data; however, withholding them may result in denial of access to YD Group premises.)
• Handling Requests Submitted via the Online Contact Form

All personal data is processed lawfully and transparently, to the extent appropriate to the given circumstances, and exclusively for the specified or compatible legal purpose, with these principles applying to each of the above purposes.

We ensure that, in processing personal data, no data is transferred to third countries outside the European Union or to international organizations.

We do not engage in automated individual decision-making or profiling in the processing of personal data.

4. TO WHOM WE PROVIDE YOUR PERSONAL DATA

The YD Group shares your personal data only with processors authorized by us to provide various services, such as accounting or tax services. These partners, acting as data processors, must adhere to strict confidentiality obligations in accordance with applicable legal regulations and/or contracts we have with them. Our processors include individuals and companies that provide us with services like camera and security system operations, product delivery, maintenance services, legal services, debt collection, technical and IT services, and other consulting and advisory activities. A list of recipients, including processors, is available upon request at info@ydc.cz.

Additionally, we may disclose your data to other recipients, both individuals and legal entities, government authorities, and other institutions, if we believe in good faith that access to, use of, retention of, or disclosure of such information is reasonably necessary to comply with applicable law or enforceable government requests, to enforce relevant contractual terms (including investigation of potential breaches), or to protect the rights, property, or safety of our company, our clients, or the public as required or permitted by law.

The YD Group will always share your personal data only to the extent necessary to fulfill the purpose of processing and only based on the appropriate legal grounds for processing. In legally specified cases, YD may, or must, transfer certain personal data, for example, to law enforcement or other public authorities.

5. HOW LONG WE PROCESS YOUR DATA

The YD Group will process your personal data only for the necessary period or as required by law, such as for the duration needed to fulfill archival obligations under the Accounting Act, the Archives and Records Act, and the Value Added Tax Act.

We may also process your personal data for the necessary period to enforce our legitimate interests, resolve any disputes that may arise, and enforce our agreements.

We process personal data for varying lengths of time depending on the purpose. Generally, personal data is stored and used for the duration of:

The business relationship with the supplier;

An additional 10 years after the business relationship ends, to protect our legitimate interests, primarily for asserting, defending, and proving our rights, interests, and claims, unless the processing is contested and your rights and interests outweigh our legitimate interests;

2 months from the date of collection for data on visits to our premises;

The time required to process requests submitted via the electronic contact form.

6. YOUR RIGHTS REGARDING THE PROCESSING OF YOUR PERSONAL DATA

Right of Access: You have the right to know whether your data is being processed and, if so, to obtain a copy of the data and related information as set forth in Article 15 of the Regulation. If you request this access unreasonably, excessively, or repeatedly, YD Group reserves the right to charge a reasonable fee for copies of the personal data provided or to refuse such requests (this applies similarly to the exercise of other rights listed below).

Right to Rectification and Completion: You can request that YD Group correct or complete your personal data if it is inaccurate or incomplete. Rectification or completion will be done without undue delay, subject to technical possibilities.

Right to Erasure: YD Group must delete your personal data if the conditions of Article 17 of the Regulation are met—for example, if the data is no longer necessary for processing purposes, if you withdraw your consent and there are no other grounds for processing, if you object to processing and there are no overriding legitimate grounds, if processing is unlawful, or if YD Group is legally obliged to delete the data.

Right to Restriction of Processing: If the conditions of Article 18 of the Regulation are met—such as in the event of any disputes regarding the processing of your personal data—YD Group will store the data and may only use it with your consent or for the establishment, exercise, or defense of legal claims until the issues are resolved.

Right to Object: You can object to the processing of your personal data based on legitimate interest; this objection will be evaluated by YD Group, and you will be informed of the decision regarding whether it was upheld or deemed unfounded, in which case your data will continue to be processed. While the objection is being resolved, processing of your data will be limited. We do not process your data for direct marketing purposes.

Right to Data Portability: You can request YD Group to transfer your personal data to a third party if you wish, thus exercising your right to data portability.

Right to Lodge a Complaint: If you believe that the processing of your personal data by YD Group violates the Regulation or other data protection laws, you have the right to file a complaint with a relevant supervisory authority, particularly in the member state of your residence, place of work, or place of alleged violation. For the Czech Republic, the supervisory authority is the Office for Personal Data Protection, located at Pplk. Right to Withdraw Consent: If the processing of personal data is based on the consent of the data subject, the subject can withdraw their consent at any time. Withdrawal of consent does not affect the processing that has already been carried out.

In addition, if you are dissatisfied, you may file a complaint with the Office for Personal Data Protection, the supervisory body overseeing personal data processing. 

7. CHANGES TO THIS POLICY

We reserve the right to make changes to this policy, but only to the extent that it does not limit your rights under this policy, or if it does so only with your explicit consent. These Privacy Policy terms have been effective since December 1, 2019.
